Test Stay Charter
Version dated 28/10/2026
1. Purpose of the charter
This charter defines the conditions under which a test stay may be offered and carried out between users of the HAVELIA platform.
A test stay is an opportunity offered to users to temporarily experience a property before a potential purchase.
2. Nature of the test stay
The test stay:
- is optional
- is at the seller's sole initiative
- is organized directly between users
- is not a service provided by HAVELIA
Only in a property free of any occupant.
In accordance with the principle of contractual freedom under Article 1102 of the French Civil Code, users freely define the terms of the stay, within the limits set by law and public order.
3. Complete absence of HAVELIA's involvement
HAVELIA acts solely as a technical matchmaking platform.
HAVELIA:
- does not organize the stay
- does not select participants
- does not manage bookings
- does not set any price
- does not receive any payment related to the stay
- does not provide any accommodation service
- does not draft any contract between users
Accordingly, HAVELIA is neither a landlord, rental intermediary, booking platform, nor agent.
4. Legal qualification
The test stay:
- does not constitute a lease within the meaning of Articles 1709 et seq. of the French Civil Code
- does not constitute a seasonal rental organized by HAVELIA
- does not constitute an accommodation service provided by HAVELIA
Users acknowledge acting outside any contractual framework involving HAVELIA.
5. Maximum duration of the test stay
The test stay is limited to a maximum duration of one (1) day. Any occupation exceeding this duration cannot be considered a test stay within the meaning of this charter and may be reclassified as a lease by the competent courts.
Users agree to strictly comply with this maximum duration. HAVELIA reserves the right to suspend access to the test stay feature in the event of any observed or reported breach.
6. Mandatory prerequisites
Before any test stay, users agree to fulfill the following conditions:
Seller's side
- verify that they hold the right to dispose of the property and are authorized to welcome a third party (in the case of a rented property, obtain prior written consent from the landlord)
- verify the property's compliance with safety standards (electrical installations, gas, smoke detectors, etc.)
- verify their comprehensive home insurance and ensure it expressly covers the presence of a non-cohabiting third party in the property
- verify applicable legal obligations (co-ownership rules, any administrative authorization, local regulations)
- verify whether the stay is subject to a municipal declaration or to the collection of the tourist tax depending on the municipality
Buyer's side
- verify that their personal liability insurance covers damages that may be caused in a third-party dwelling
- verify the conditions and terms of the stay agreed upon with the seller
- ensure they have adequate insurance coverage for the duration of the stay
7. Insurance
Insurance is a critical point. Each user is responsible for verifying their own coverage before the stay.
Users acknowledge that:
- the seller must have comprehensive home insurance expressly covering the presence of a non-cohabiting third party in the property for the duration of the test stay
- the buyer must be covered by personal liability insurance covering damages caused in a third-party dwelling
- additional specific insurance may be necessary depending on the nature and duration of the stay
HAVELIA strongly recommends obtaining additional insurance tailored to the situation.
HAVELIA does not verify users' insurance and cannot be held liable in the event of an uncovered claim.
8. Stay conditions
Users freely define between themselves:
- the duration of the stay (within the limit of seven consecutive days provided for in Article 5)
- the potential price or gratuity of the stay
- the amount of any deposit
- the rules of occupation of the property
- the terms of the entry and exit inventory
- the cancellation conditions
Tax obligations: users are solely responsible for their tax and reporting obligations related to any payment received in the context of the test stay (income declaration, tourist tax, etc.). HAVELIA does not intervene in any capacity in these obligations.
HAVELIA does not intervene in any of these conditions and cannot be held liable for the consequences of agreements concluded between users.
9. Liability
In accordance with Article 1240 of the French Civil Code, each user is liable for damages caused to others through their fault.
HAVELIA cannot be held liable, in particular for:
- material or bodily damages occurring during or in connection with the stay
- theft or deterioration
- disputes between users
- cancellations or modifications of the stay
- non-compliance of the property with agreed conditions
- consequences of absent or insufficient insurance
- tax, administrative, or regulatory consequences of the stay
10. General obligations of users
Users agree to:
- act in good faith in all their exchanges
- comply with applicable laws and regulations
- respect the property made available and its equipment
- follow the rules agreed upon by mutual consent
- not commit fraud or attempt to misuse the platform
- mutually verify identities before the stay
11. Disputes
Any dispute related to the test stay is exclusively between the users concerned.
HAVELIA does not intervene in the resolution of disputes between users.
For any dispute between a user and HAVELIA regarding the platform, users are invited to refer to the provisions of the Terms of Use relating to consumer mediation and competent jurisdictions.
